According to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014: Temporary resident card is a document issued by an immigration authority or a competent authority of the Ministry of Foreign Affairs to foreigners who are allowed to reside for a definite time in Vietnam. A temporary resident card can replace a visa.
Conditions for applying for a temporary resident card for foreigners include:
– Passport of foreigners still valid for at least 13 months
– Valid visa in Vietnam must be for the right purposes (Visa types of TT, LD, DN, etc.);
– Having a work permit with a minimum validity of 12 months.
– Business owner investing in Vietnam.
– Father, mother, wife, husband, etc. bearing Vietnamese nationality.
The dossier of application for the temporary resident card for a foreigner with a work permit comprises the following papers:
– Operation certificate of the enterprise employing foreign employees (Business Registration Certificate, Investment License, Operation License of Representative Office or branch, etc.)
– Certificate of seal sample registration or a written notice of posting information about the seal sample of the enterprise on the national portal of enterprise registration
– Work permit of foreign employee
– Form NA16 – Registration of seal samples and signatures for the first time at the Immigration Agency
– Form NA6 – Official Letter and application for the temporary resident card for foreigners
– Form NA8 – Declaration for applying for the temporary resident card for foreigners
– Letter of introduction for Vietnamese employees who carry out the procedures to apply for the temporary resident card at the Immigration Office.
– Original passport (The passport must include a visa for the right purpose of employment. In case the foreign employee has been granted a temporary resident card before, it must be attached to the submitted dossier);
– The certificate of temporary residence registration or temporary residence registration book of the foreigner, which has been verified by the public security of the ward or commune where the foreigner is temporarily residing in Vietnam.
– 02 (2 × 3)cm photos, bare-headed, taken right in the front, clear face, clear ears, without colored glasses, taken for less than 6 months;
Documents for accompanying relatives of the foreigner:
In addition to the foreign employee’s dossier, the accompanying relative needs to provide the following documents:
Copies of documents proving the purpose of applying for temporary residence certification: depending on each specific case, a certified true copy of the certificate of marriage, certificate of birth, or papers proving family relation must be submitted.
The dossier of application for a temporary resident card for foreigners whose parent(s) or spouse bearing Vietnamese nationality includes the following papers:
– Form NA7 – Official Letter and an application for the temporary resident card for foreigners (certified by the ward/commune where the sponsor is residing)
– Form NA8 – Application for the temporary resident card for foreigners
– Original passport (The passport must include a visa for the right purpose of employment. In case the foreign employee has been granted a temporary resident card before, it must be attached to the submitted dossier);
– Family register and ID card of the sponsor
– 02 (2 × 3) cm photos, bare-headed, taken right in the front, clear face, clear ears, without colored glasses, taken for less than 6 months;
Copies of papers proving the family relationship: Certificate of marriage; Certificate of birth; etc.
Place of submission of temporary residence card: Immigration Department or Immigration Division.
The processing time is five working days from the date of submission.
